By downloading, accessing, or using ThrillEats, you agree to be bound by these Terms. If you do not agree, please do not use the app.

1. About ThrillEats

ThrillEats is a mobile app designed to guide users through theme park food experiences by providing ratings, reviews, gamification features, and trip-planning tools. ThrillEats is not affiliated with, endorsed by, or officially connected to any theme park, venue, or brand (including, but not limited to, Disney, Universal, or other third-party companies). ThrillEats is an independent platform operated solely by ThrillEats, Inc.

We do not guarantee the accuracy, completeness, or timeliness of any information provided in the app, including but not limited to food descriptions, menus, prices, schedules, hours of operation, or availability.

2. Allergy, Dietary & Safety Disclaimer

ThrillEats provides user-generated content, reviews, and recommendations for informational purposes only.

  • We do not guarantee the accuracy, completeness, or reliability of menu items, ingredients, prices, hours, or other details displayed in the app.

  • Food offerings, availability, and costs may change without notice.

  • ThrillEats is not responsible for inaccurate, outdated, or incomplete information provided by users, venues, or third-party sources.

  • ThrillEats is not responsible for any allergies, dietary restrictions, or health outcomes related to food or beverage consumption.

  • ThrillEats does not verify or guarantee whether any food or beverage item meets religious dietary requirements (including but not limited to kosher, halal, vegetarian, or vegan guidelines).

  • Always confirm ingredients, allergens, religious dietary compliance, pricing, and preparation methods directly with the venue or vendor before consuming or purchasing.

  • ThrillEats accepts no liability for illness, injury, financial loss, or adverse reactions related to food, beverages, or venue information.

3. Risk, Information Accuracy & Liability

By using ThrillEats:

  • You acknowledge that ThrillEats does not own, operate, or control any park, venue, ride, or food establishment.

  • ThrillEats bears no responsibility for your safety, choices, or experiences at any venue.

  • ThrillEats does not guarantee the accuracy, availability, or timeliness of any information including menu items, prices, schedules, promotions, or venue details.

  • ThrillEats accepts no liability for decisions made in reliance on information within the app.

  • You assume all risks associated with eating, traveling, spending money, or participating in activities based on information provided by the app.

  • ThrillEats holds no responsibility for your phone or mobile device operations, including but not limited to battery life, memory capacity, storage space, connectivity, or performance while using the app.

  • You are solely responsible for safe use of your mobile device at venues. This includes following all park rules, guided instructions, safety signage, ride restrictions, area restrictions, and mobile device use policies as established by the venue.

4. Vacation, Events & Weather Disclaimer

ThrillEats is a planning and guidance tool only. We do not sell tickets, travel, or vacation packages. ThrillEats holds no responsibility for the success, enjoyment, or fulfillment of your planned trip, including but not limited to:

  • Weather conditions (rain, heat, storms, hurricanes, etc.)

  • Venue closures, ride shutdowns, or park capacity restrictions

  • Event cancellations, rescheduling, or sold-out experiences (including seasonal festivals, holiday events, or special ticketed parties)

  • Cancellations or issues with vacation purchases such as park tickets, dining reservations, hotel bookings, or travel arrangements

  • Personal circumstances that impact your ability to attend or enjoy your trip

You agree that ThrillEats is not responsible for the outcome of your trip or activities. Always confirm details directly with official park and venue operators.

5. User Accounts

  • You must be at least 13 years old to use ThrillEats.

  • If under 18, you may only use ThrillEats with parental/guardian consent, and parents/guardians assume full responsibility for minor users.

  • You are responsible for maintaining the confidentiality of your account information.

  • ThrillEats reserves the right to suspend or terminate accounts that violate these Terms.

  • ThrillEats accepts no responsibility for errors, omissions, or losses that result from inaccurate user account information.

6. User Conduct & Non-Discrimination

ThrillEats is committed to being an inclusive, respectful community.

  • We welcome all users regardless of race, ethnicity, religion, gender, sexual orientation, disability, age, or beliefs.

  • Users may not post content that is discriminatory, harassing, hateful, threatening, or otherwise harmful toward individuals or groups.

  • ThrillEats reserves the right to remove such content and suspend or terminate accounts that engage in harassment, hate speech, or discriminatory behavior.

7. User Content

By submitting reviews, ratings, photos, or other content to ThrillEats, you grant ThrillEats a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for app functionality and promotional purposes.

  • You are solely responsible for your submissions.

  • Do not post unlawful, defamatory, harmful, or infringing content.

  • ThrillEats is not responsible for inaccurate, misleading, or false user-generated content.

  • Reviews and ratings reflect user opinions and are not endorsements by ThrillEats.

  • ThrillEats reserves the right to remove, moderate, or restrict content that violates these Terms.

8. Intellectual Property

All trademarks, logos, app features, gamification systems, badges, and designs related to ThrillEats are owned by ThrillEats, Inc. Unauthorized use, reproduction, or scraping is prohibited.

Third-party brand names or items mentioned within the app are the property of their respective owners and appear solely for identification purposes. ThrillEats does not guarantee the accuracy of any third-party brand or product information.

9. Rewards & Gamification

ThrillEats may offer points, badges, achievements, or other gamification features.

  • These have no cash value unless expressly stated.

  • Rewards, points, and achievements are non-transferable, non-exchangeable, and cannot be sold, gifted, traded, or redeemed outside of ThrillEats’ system.

  • ThrillEats may change, suspend, or discontinue rewards programs at any time without notice.

  • ThrillEats does not guarantee the accuracy of reward descriptions, redemption values, or availability of rewards.

  • ThrillEats is not responsible if a third-party partner (such as a gift card provider) changes terms or fails to honor a reward.

  • We do not guarantee accuracy, completeness, or availability of location-based data.

  • ThrillEats is not responsible for errors, delays, or consequences related to location inaccuracy, misdirection, or missed events.

  • ThrillEats does not guarantee accuracy of event dates, menus, pricing, or availability.

  • Venues may change offerings without notice, and ThrillEats bears no responsibility for discrepancies.

  • We make no guarantees of uninterrupted or error-free service.

  • ThrillEats disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

  • ThrillEats disclaims responsibility for the effect of app usage on your device’s battery, storage, performance, connectivity, or functionality.

  • No Professional Advice: Information in ThrillEats is for entertainment and general guidance only. It does not constitute medical, dietary, religious, financial, or legal advice.

13. Limitation of Liability

To the fullest extent permitted by law, ThrillEats, Inc. and its officers, employees, and affiliates shall not be liable for any damages, including but not limited to direct, indirect, incidental, punitive, or consequential damages, arising from:

  • Your use of the app

  • Reliance on information in the app (including inaccurate or outdated prices, menus, or details)

  • Food consumption, travel, or park activities

  • Participation in or reliance upon gamification, points, or reward features

  • Any impact to your mobile device, including but not limited to battery depletion, storage capacity, data usage, or operational performance

  • Weather conditions, event cancellations, venue closures, or vacation purchase issues

  • Failure to follow venue-specific rules, ride restrictions, safety signage, or mobile device use policies

14. Third-Party Links & Integrations

ThrillEats may include links to third-party websites or services.

  • We are not responsible for their content, policies, or practices.

  • ThrillEats does not guarantee the accuracy of any third-party information, prices, or promotions accessed through these links.

15. Privacy & Data

Your use of ThrillEats is also subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using ThrillEats, you consent to such collection and use.

16. Indemnification

You agree to indemnify, defend, and hold harmless ThrillEats, Inc., its affiliates, employees, and partners from any claims, damages, liabilities, losses, or expenses (including legal fees) arising out of:

  • Your use of ThrillEats

  • Your violation of these Terms

  • Your content submissions

  • Your violation of park, venue, or third-party rules or rights

17. Termination of Service

ThrillEats may suspend, restrict, or terminate your account or access to the app at any time, for any reason, without liability or prior notice. ThrillEats may also discontinue or modify any part of the app or services at its sole discretion.

18. App Store Compliance

If you access ThrillEats through the Apple App Store, Google Play Store, or any other distribution platform, you agree to comply with their applicable terms of service and policies in addition to these Terms.

19. Force Majeure

ThrillEats is not liable for delays, interruptions, or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, government actions, power outages, or network failures.

20. Arbitration & Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of ThrillEats shall be resolved by binding arbitration in the State of Delaware, except where prohibited by law. You agree to waive the right to participate in class actions or jury trials.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThrillEats regarding your use of the app, and supersede any prior agreements, communications, or understandings.

23. Export & Use Restrictions

You agree not to use ThrillEats in violation of U.S. export control laws or in jurisdictions where the app is prohibited by law.

24. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions.

25. Changes to Terms

ThrillEats may update these Terms & Conditions at any time. Continued use of the app after changes are posted constitutes acceptance of the updated Terms. ThrillEats does not guarantee advance notice of changes to information, features, or services.
